Waste Removal Hammersmith Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Hammersmith provides waste collection and related services to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation that requests or receives services from Waste Removal Hammersmith.

Services means any waste removal, rubbish collection, bulky waste clearance, house or office clearance, garden waste removal or related services provided by us.

Waste means any items, materials or substances presented by you for collection and disposal as part of the Services.

We, us and our means Waste Removal Hammersmith, the service provider.

Agreement means the contract between you and us for the provision of Services, incorporating these Terms and Conditions and any specific details confirmed in your booking.

2. Scope of Services

We provide waste collection and removal services within Hammersmith and surrounding areas, subject to our operational capacity. The specific Services to be provided, including the type and approximate volume of Waste to be collected, the collection date and time window, and any special requirements, will be agreed with you at the time of booking.

We reserve the right to refuse to collect Waste that we reasonably believe to be hazardous, illegal, improperly described, excessively heavy, unsafe to handle, or not in accordance with these Terms and Conditions or applicable waste regulations.

3. Booking Process

3.1 You may request a booking by telephone, email or through any online form we make available. When you contact us, we will request information regarding the nature and quantity of Waste, the collection address, access arrangements and your preferred collection date and time frame.

3.2 Based on the information you provide, we will give you a quotation or an estimated price. This estimate may be subject to change if the actual Waste presented for collection materially differs from your description, in size, weight, type or accessibility.

3.3 A booking is only confirmed when we accept your request and provide you with a booking confirmation, which may be given verbally, in writing or by electronic communication. The Agreement between you and us is formed at the point of confirmation.

3.4 You are responsible for ensuring that all information provided during the booking process is accurate and complete. If key details are incorrect or omitted, we may adjust the price, alter the Services, or cancel the booking.

3.5 We will use reasonable efforts to arrive within the agreed time window, but all times given for attendance are estimates only and not guaranteed. Circumstances such as traffic, weather or operational issues may occasionally cause delays.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe, lawful and reasonable access to the collection address and to the Waste to be removed. This includes arranging for entry to any building, car park, loading area or private land as necessary.

4.2 All Waste to be collected must be readily accessible, clearly identifiable and not mixed with items you wish to retain. We are not responsible for removing items that were not intended for disposal but were presented or stored with the Waste.

4.3 If parking is required for our vehicle, you are responsible for arranging any necessary permissions, permits or payments unless otherwise agreed in advance. Any parking fees, penalties or related charges incurred due to inadequate arrangements may be charged to you.

4.4 You must not present for collection any Waste that is hazardous, explosive, radioactive, highly flammable, medical or clinical, pressurised, or otherwise restricted under applicable UK waste regulations unless we have expressly agreed in writing to handle such materials and have quoted accordingly.

4.5 If we are unable to carry out the Services due to lack of access, unsafe conditions, incorrect information, or the presence of prohibited Waste, we may charge a call-out or wasted journey fee to cover our costs.

5. Pricing and Quotations

5.1 Prices are generally based on the volume, weight and type of Waste, as well as any additional labour, access difficulties or special handling that may be required. We may also take into account travel distance and disposal charges.

5.2 Any quotation or estimate provided prior to arrival is given in good faith based on the information supplied by you. If, upon arrival, we determine that the Waste is significantly different in quantity, type or accessibility, we will discuss any price adjustment with you before proceeding.

5.3 If you do not agree to any updated price, you may decline the Service at that point. However, we reserve the right to charge a reasonable call-out or assessment fee to cover our time and costs incurred up to that point.

5.4 All prices are stated exclusive of any applicable VAT or other taxes unless otherwise indicated. Where VAT is applicable, it will be added at the prevailing rate.

6. Payment Terms

6.1 Payment is due on completion of the Services, unless we have agreed alternative credit terms in writing. We may require a deposit or full payment in advance for certain bookings, particularly large clearances or commercial work.

6.2 We accept payment by cash, bank transfer, or card, subject to the methods we make available at the time of collection. You agree to ensure that sufficient funds are available and that any payment method used is valid and authorised.

6.3 Where payment is not made on completion, any credit terms will be stated in the booking confirmation or invoice. If you fail to pay on time, we may charge interest on the overdue amount at the statutory rate allowed under UK law, as well as reasonable costs of recovery where permitted.

6.4 You must raise any queries regarding an invoice within seven days of the invoice date. After this period, you will be deemed to have accepted the invoice as correct.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us as soon as possible. Cancellations or changes requested at least 24 hours before the scheduled collection time will normally be accepted without charge.

7.2 If you cancel or materially change your booking with less than 24 hours notice, we reserve the right to charge a late cancellation fee or a proportion of the quoted price to cover our allocated time and resources.

7.3 If we arrive at the collection address at the agreed time and are unable to carry out the Services due to reasons beyond our control, such as lack of access or incorrect information, we may treat this as a late cancellation and charge a wasted journey fee.

7.4 We may cancel or reschedule a booking at any time if we are unable to perform the Services due to events beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, safety concerns or legal restrictions. We will notify you as soon as reasonably practicable and offer an alternative appointment where possible.

8. Waste Handling and Compliance

8.1 We operate in accordance with applicable UK waste management and environmental laws and regulations. Collected Waste will be transported and disposed of or recycled through authorised facilities, with the aim of minimising landfill use where reasonably practicable.

8.2 By presenting Waste to us for collection, you confirm that you are the owner of the items or that you have full authority from the owner to dispose of them. You agree to indemnify us against any claim brought by a third party alleging that items were removed without proper authorisation.

8.3 Once Waste has been loaded onto our vehicle and the Service is complete, title to the Waste passes to us, and you relinquish any rights or claims over those items.

8.4 You must not present for disposal any items that are subject to ongoing disputes, finance agreements, retention of title claims or similar encumbrances.

8.5 We may refuse to collect any Waste that appears to be in breach of UK waste regulations, including but not limited to hazardous substances, liquids in unsealed containers, asbestos, chemicals and clinical waste, unless specific arrangements have been made and confirmed in writing.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. However, we will not be liable for any loss or damage arising from inaccurate information provided by you, unsafe access conditions, or your failure to comply with these Terms and Conditions.

9.2 While carrying out the Services, we will take reasonable steps to avoid damage to property. You should remove or protect any vulnerable items or surfaces in areas through which Waste must be carried. We are not liable for normal wear and tear or minor scuffs and marks that may occur when moving bulky items through confined spaces.

9.3 If we are found liable for damage to property, our liability will be limited to the reasonable cost of repair or replacement of the damaged item, taking into account its age and condition, subject to any exclusions permitted by law.

9.4 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.

9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or limited under applicable UK law.

10. Customer Property and Mistaken Removal

10.1 You are responsible for ensuring that items intended to be kept are clearly separated from Waste and not presented for collection. We have no obligation to question whether any items presented are Waste, provided they appear to have been made available for removal.

10.2 If you believe that an item has been removed in error, you must notify us immediately. We will make reasonable efforts to locate and recover the item if it is still in our possession and has not yet been processed, but we cannot guarantee recovery once items have been mixed with other Waste or handled by disposal facilities.

10.3 If an item removed in error cannot be recovered, our liability, if any, will be assessed in accordance with the limitation of liability provisions set out in these Terms and Conditions.

11. Insurance

11.1 We maintain appropriate insurance cover in relation to our operations, including public liability insurance, in line with industry practice.

11.2 The existence of insurance does not extend or increase our liability beyond the limits set out in these Terms and Conditions or as required by law.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of the Services, you should contact us as soon as possible, providing full details of the issue. We will investigate your concerns and aim to respond within a reasonable time.

12.2 Where appropriate, we may offer to rectify the issue, provide a partial refund or take other reasonable steps to resolve the matter. Any remedy offered will be without prejudice to our rights under these Terms and Conditions.

12.3 If a dispute arises that cannot be resolved directly between us, either party may consider using mediation or other alternative dispute resolution methods before commencing formal legal proceedings.

13. Force Majeure

13.1 We will not be liable for any delay in performing, or failure to perform, our obligations under the Agreement if such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to severe weather, natural disasters, accidents, strikes, acts of terrorism, legal restrictions or utility failures.

13.2 If a force majeure event continues for a prolonged period, we may cancel the Agreement without liability, and any advance payments for Services not yet performed will be refunded.

14. Data Protection and Privacy

14.1 We will collect and process personal information about you only as necessary to manage your booking, provide the Services and handle payments and administration.

14.2 We will take reasonable steps to keep your personal information secure and will not sell or share your details with third parties except where necessary to provide the Services, comply with legal obligations, or with your consent.

14.3 You may request access to the personal information we hold about you and request corrections where appropriate, in accordance with applicable data protection laws.

15. Variations to these Terms

15.1 We may amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements, or our business practices. The updated version will apply to all Services booked after the date on which the changes take effect.

15.2 The Terms and Conditions in force at the time of your booking will apply to that specific Agreement, unless a change is required by law or regulatory authority.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any Agreement arising from them, are governed by and construed in accordance with the laws of England and Wales.

17.2 Any dispute or claim arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
